The Rights and Duties of Widows in Pakistani Laws and Contemporary Perspectives: A Case Study of Peshawar and Katling District

Abstract

Family law is paramount importance in the development, success and prosperity of any nation as it pertains to the caste and personality of every individual living in the society and therefore affects both the individual and the family. The first thing that comes to mind is the act of marriage. After marriage, if there is no harmony between the spouses, then the stage of divorce comes, because divorce takes place only after marriage, and then there is the rule of 'iddah with it, which is fulfilled. It is the shar'i responsibility of divorced and widowed women to do so. After 'iddah, the issue of lineage arises. That is why the lineage is known. If the lineage is not known, then nothing will come to the woman's side except humiliation and disgrace. In order to avoid disgrace, the 'iddah has been warned.The aim of this research article to highlight the rights and duties of widows in the light of Pakistani laws and the current scenario of districts of Peshawar and Katlang.
